Legal drafting has a long tradition of dense, archaic language — but courts increasingly favour plain English and will use ordinary meaning to interpret ambiguous terms. Complex language often creates ambiguity rather than precision. The best legal drafters write as clearly and simply as the subject matter allows — using defined terms consistently, avoiding unnecessary synonyms, and structuring provisions so the logic is immediately apparent. A contract that both parties understand is far less likely to end up in litigation than one that only a lawyer can parse.

How to Practise
- 1.Take a published contract template and redline it: identify every provision that could be clearer, every risk that is unaddressed, and every definition that is ambiguous — then redraft the problematic sections.
- 2.Draft a short commercial agreement from scratch (e.g. a simple services agreement or NDA) without using a template, then compare your draft to a published precedent to identify what you missed.
- 3.Study the principles of contract interpretation in your jurisdiction — how courts approach ambiguous drafting — and apply them to identify drafting that would be interpreted differently than the parties intended.
- 4.Complete a legal drafting course (Practical Law drafting resources, LPC/BTC modules, or Commercial Awareness resources) focused on the specific document types relevant to your practice area.
