Identifying primary authority is the starting point. Legal research must also confirm that the authority is still good law, understand how it has been applied and distinguished in subsequent cases, identify jurisdiction-specific variations, and consider whether the facts of the current matter are sufficiently analogous or sufficiently different that the authority applies, applies differently, or can be distinguished. Research that identifies authority without checking its current status or considering its application produces unreliable legal advice.

How to Practise

  • 1.Practise formulating precise research questions before starting research: translate a client scenario or legal problem into the specific legal questions that need to be answered, identifying the jurisdiction, the relevant area of law, and the specific rule or principle at issue.
  • 2.Use both free and subscription legal research databases for the same research question — compare the results from BAILII and Westlaw for a case law search to understand the strengths and limitations of each platform.
  • 3.Practise case law analysis: for each case you find, read the headnote, identify the ratio decidendi, assess whether the case is binding or persuasive in the relevant court, check whether it has been followed, distinguished, or overruled in subsequent cases (using the Westlaw "cases citing" function or KeyCite), and summarise the principle it establishes.
  • 4.Write legal research memoranda — structured documents that set out the research question, the methodology used, the key sources found, the analysis of those sources, and the conclusions. Submit these for feedback from a qualified practitioner or law tutor.
