Most enforcement is resolved through advice, warnings, and notices. Prosecution is a last resort used when other interventions have failed.
"Effective enforcement means applying the rules consistently — discretion creates unfairness."
Consistency is necessary but not sufficient. Enforcement discretion exists because identical rule text applies to situations with different context, intent, and consequence. Practitioners who apply rules without situational judgement create enforcement outcomes that are technically consistent but practically unjust — and which do not achieve the regulatory objective the rule was designed to serve.
